Attorneys representing 13 Pure put forth their best argument to the Colorado Springs liquor board that the night club’s license should not be suspended after women exposed their breasts during a filming of “Girls Gone Wild” last year. The lawyers claim the punishment was too severe and that the women had a First Amendment right to bare themselves.

But Fourth Judicial District Judge Theresa Cisneros eventually rejected those arguments and upheld the 10-day suspension, finding that the liquor board didn’t exceed its jurisdiction or discretion, writes the Gazette. City police busted the club during an undercover operation in August 2008.

“At least one young woman openly fondled the breast of another young woman at the nightclub,” according to records. “Still another young woman took her shirt off completely, exposing her breasts. Some of the acts were captured on videotape and other acts were described by witnesses.”

Attorney Michael W. Gross, who represented the nightclub owners, says his clients are considering their options, including an appeal. The deadline to appeal is Thursday.

Meanwhile, affairs are tamer at the new, much-discussed, Scots-themed Tilted Kilt Pub & Eatery in downtown Denver, where the waitstaff’s tartan costumes cover “about as much skin as a plaid bikini,” notes The Denver Post.
