Francis Hernandez, the man who lost control of his SUV after gunning the engine, was found guilty yesterday of killing three people, including a toddler, after crashing into a Baskin Robbins ice cream shop on South Havana Street in 2008. Hernandez’s lawyers tried to argue that his cousin, Christian Hernandez, was driving, but the jury didn’t buy it, returning guilty verdicts on 18 of the 19 criminal charges Hernandez faced, including vehicular homicide, reports the Aurora Sentinel. After the verdict, Arapahoe County District Court Judge John Wheeler tacked a “guilty” onto the 19th charge: driving while under restraint. Hernandez could now face roughly 100 years in prison if sentenced to consecutive terms on April 5, according to The Denver Post. “This guy is a baby killer,” says Marat Kudlis, father of three-year-old Marten Kudlis, who was killed in the crash. “He should be where he is.” Following the verdict, the Aurora Police Department issued a statement expressing gratitude to the jury, but also acknowledges that the officer accused by defense lawyers of excluding a key quote from a written report is under investigation by Internal Affairs (via Westword).
