Erin Toll, the executive director of the Colorado Division of Real Estate who’s been criticized for investigating American Home Funding, has filed a whistleblower complaint alleging that her boss involuntarily placed her on administrative leave. Toll also believes she is “being targeted for termination,” according to the complaint filed with the State Personnel Board, and she wants to be returned to the board at her “full power and authority,” reports INDenverTimes’ Inside Real Estate News. Toll is being investigated for her actions in the wake of a public dispute with state Senator Ted Harvey, a Highlands Ranch Republican and broker at American Home who Toll claims may have misused his power and engaged in unethical behavior. Harvey, Toll told news media at one point, was under investigation, but the state regulatory agency that oversees Toll later said that was not the case. State Bill Colorado (via INDT) highlights the conflict between Toll and Harvey, with a recording from a March 2 state Senate hearing that let’s you decide whether this is a case of a too-tough regulator overstepping her bounds or a legislator improperly using his power to strike back.
