Ft. Collins to Get Medical Marijuana Shop

A medical marijuana shop will open Monday in Fort Collins.

James and Pat Fleming say they plan to serve the needs of people who suffer from chronic pain and other illnesses and that they're "not out to be legal drug dealers." The EnerChi Healing Center store would be the first of its kind in Fort Collins. Other services they will offer include yoga, hypnosis, nutrition and meditation.

Is it legal? According to Fort Collins police, the answer is yes, provided the Flemings are certified providers and their customers have a state-issued medical marijuana card and a doctor's prescription. Colorado's law approving medical pot passed in 2000. Here are the rules regulating it (pdf) and the application forms. Have more questions? Not really a doctor’s prescription per se, as that, on the face, I believe to be illegal federally. It is assumed that you were referring to the physician's recommendation. Court cases statewide have found judges clarifying that the moment of 'legal protection' for the patient to be the moment when the doctor puts pen to paper. This is found to be in direct contrast with policy of the state registry, who maintains a policy that a patients legal protection doesn't beging until after the state provides the patient with a registry certificate.
