Edward Lyons’ distinguished legal career spans more than four decades. He has attained broad recognition within Colorado, as well as nationally, for excellence and outstanding achievements in the fields of complex commercial litigation, public utilities law, and motor and rail carrier transportation.
The lengthy list of published cases in which Ed has achieved favorable outcomes for clients includes such notables as the more than decade-long litigation in federal and state courts vindicating the right of the developer of a large-scale interstate, solid-waste disposal site in South Dakota, to an award of just compensation from the State of South Dakota. This was declared under the Fifth and Fourteenth Amendments of the U.S. Constitution, for an uncompensated “regulatory taking” resulting from an unconstitutional statewide referendum that stopped the project.
More recently, in another nearly decade-long litigation, Ed successfully opposed attempts by the Colorado Attorney General to enforce regulatory subpoenas directed at two American Indian tribal business organizations that were engaged in making short-term loans throughout the United States via the Internet, thus upholding their sovereign immunity from suit. And, still more recently, returning to the field of transportation law where he began his practice many years ago, Ed successfully upheld the legal right of Colorado’s legendary Durango & Silverton Narrow Gauge Railroad (which many years before he was instrumental in organizing), to authorize the City of Durango to construct a pedestrian and bicycle trail within a portion of the railroad right-of-way over the objection of a landowner through whose land the railroad held a right-of-way easement.
Prior to obtaining his J.D. degree at the University of Michigan Law School, Ed served as a commissioned officer in the United States Navy.
