Donald Hertz Indicted Under FACE Law


Seventy-year-old Donald Hertz called the Boulder Abortion Clinic and threatened to kill Dr. Warren Hern and members of his family just weeks after Kansas abortion doctor George Tiller was fatally shot in May. And according to a grand jury indictment issued yesterday, Hertz also tried to intimidate employees at the clinic. “This kind of terrorism has to stop,” Hern tells Boulder’s Daily Camera. “I’m very grateful for the hard work the FBI and the U.S. Marshals Service did to find this man who made a threat to my family.” Esquire calls Hern the “last abortion doctor,” noting his 36 years of work specializing in late-term abortions. Tiller was the other. Hertz is charged with violating the Freedom of Access to Clinic Entrances Act, which makes it a federal crime to injure, intimidate, or interfere with, by force or threat of force, employees of a facility that provides reproductive health services, writes The Denver Post, which adds that Hertz is the first person in the nation to be charged under the law since Tiller was killed. Hertz faces a prison sentence of up to six years and a fine of up to $350,000.
